Untrack Cycling — Terms of Use

These Terms of Use (the “Terms”) apply to the Untrack Cycling mobile application, website, subscription features, route planning tools, ride recording tools, and related services (together, the “Service”).

Please read these Terms carefully before using the Service. By downloading, accessing, creating an account, starting ride recording, subscribing to Untrack Pro, or otherwise using the Service, you agree to these Terms.

If you do not agree to these Terms, do not use the Service.


1. Operator and Application Provider

For purposes of disclaimers, limitations of liability, releases, indemnity, intellectual property protection, and enforcement of these Terms, “Untrack” also includes, to the maximum extent permitted by law, the Service’s owners, founders, developers, contributors, contractors, service providers, licensors, agents, successors, and assigns (the “Protected Parties”).


2. Apple Standard EULA and Supplemental Terms

Untrack Cycling is distributed through the Apple App Store. The app is licensed to you, not sold.

Unless a separate custom license is provided in App Store Connect, your license to use the iOS app is governed by Apple’s Standard Licensed Application End User License Agreement (the “Apple Standard EULA”). These Terms are supplemental terms that apply to the Service, including accounts, subscriptions, route features, ride recording, privacy-related choices, acceptable use, outdoor risk disclosures, and limitations of liability.

If there is a conflict between the Apple Standard EULA and these Terms regarding the license to the iOS app, the Apple Standard EULA controls to the extent of that conflict. These Terms continue to apply to the Service and your use of Untrack.

Apple is not responsible for route decisions, ride recording, maps, weather, GPS accuracy, user content, route recommendations, subscription entitlement systems operated by Untrack, or any outdoor activity you undertake using the Service, except as required by applicable law or the Apple Standard EULA.


3. What Untrack Does

Untrack Cycling is a cycling app that may provide features such as:

The Service is provided for informational and planning purposes. Untrack does not guarantee that any route is safe, legal, open, public, appropriate, accurate, complete, or suitable for your ability, equipment, health, location, weather, or road conditions.


4. Eligibility

You must be at least 13 years old to use the Service. If you are located in a country where a higher age is required to lawfully use online services or consent to data processing without parental consent, you must meet that higher age or have appropriate parental or guardian consent.

You may not use the Service if you are prohibited from using it under applicable law.


5. Accounts and Security

Some features require an account. You agree to provide accurate information and to keep your account credentials secure.

You are responsible for activity under your account, except where caused by Untrack’s failure to use reasonable security measures. Notify us promptly if you believe your account has been accessed without authorization.

We may suspend or terminate accounts that violate these Terms, create legal risk, abuse the Service, threaten security, infringe third-party rights, or use the Service in a dangerous, unlawful, or harmful way.


6. Untrack Pro Subscriptions and Payments

Untrack Pro is available through Apple App Store auto-renewable subscriptions. The current subscription products supported in the app purchase flow are:

Product IDs are listed for transparency and may not always be visible to users in the purchase flow. The purchase screen shown before confirmation controls the current subscription offer.

Untrack Pro unlocks the Pro features shown in the purchase screen. These may include, depending on the current version of the app, enhanced route planning, saved route features, training route planning, ride recording features, GPX export, route context, activity summaries, or other Pro functionality shown before purchase.

Before you confirm purchase, the app will show the subscription name, subscription duration, localized price, renewal terms, trial or introductory offer terms if applicable, and links to these Terms and our Privacy Policy.

Payment is charged to your Apple Account at confirmation of purchase. Your subscription renews automatically unless cancelled at least 24 hours before the end of the current subscription period. Your Apple Account may be charged for renewal within 24 hours before the end of the current period.

You can manage, cancel, or change your subscription in your Apple Account settings. You can use “Restore Purchases” in the app to restore an active entitlement.

Deleting your Untrack account or uninstalling the app does not cancel your Apple App Store subscription. You must cancel subscriptions through your Apple Account settings.

Refund requests for App Store purchases are handled by Apple under Apple’s policies and applicable law. Untrack does not receive or store your full payment card details.

Prices are shown in the purchase flow before confirmation and may vary by country, currency, taxes, App Store settings, promotional availability, and Apple configuration. Subscription features may vary by app version and platform.

App-level trial

Untrack may offer a one-time app-level Pro trial, such as a 3-day trial, through our own backend. This trial gives temporary access to Pro features for the stated trial period. It does not automatically convert into a paid App Store subscription unless you separately complete a purchase through the App Store.

If Apple introductory offers, promotional offers, or other App Store offers are made available, their terms will be shown in the purchase flow before confirmation.


7. Location, Background Recording, and Device Permissions

Untrack relies on device permissions to provide location-based and ride recording features. Depending on your settings, the Service may use precise location, approximate location, background location, network connectivity, device sensors, push notification permissions, or other device-level capabilities.

Background ride recording may be affected by device settings, operating-system restrictions, location permissions, battery level, Low Power Mode, app termination, sensor quality, GPS signal, network availability, provider outages, or environmental conditions. Untrack does not guarantee continuous recording, live location availability, automatic pause/resume accuracy, distance accuracy, elevation accuracy, speed accuracy, or successful GPX export in all circumstances.

You are responsible for configuring your device, permissions, and battery settings appropriately before riding.


8. Outdoor, GPS, Map, Weather, and Route Risks

Untrack is an informational cycling planning and recording tool. It is not an emergency service, dispatch service, professional navigation system, road-safety authority, land-access registry, weather warning service, medical service, coaching service, or substitute for your own judgment.

Cycling involves inherent risks, including collision, injury, illness, property damage, and death. Roads, trails, cycleways, crossings, bridges, surfaces, closures, construction, traffic, lighting, weather, temperature, visibility, legal access, and private-property boundaries may differ from what appears in the Service.

GPS, maps, routing, elevation, surface, traffic, weather, air-quality, road-confidence, Route Confidence, and other route context may be inaccurate, incomplete, delayed, unavailable, outdated, or unsuitable for your ability, equipment, route, or location.

You are solely responsible for deciding whether to ride, where to ride, whether a route is lawful and appropriate, your compliance with road and traffic laws, signs and closures, obtaining any required permission to enter land, your equipment and protective gear, your physical condition, and remaining alert.

Never interact with the app in a way that distracts you while riding. Stop in a safe and lawful place before using the app.

In an emergency, contact local emergency services directly.


9. Route Confidence, Road Context, and Informational Estimates

Route Confidence, road confidence, surface labels, difficulty estimates, weather windows, training route suggestions, elevation estimates, route popularity, road context, and similar indicators are informational estimates only.

They are not safety ratings, guarantees, professional advice, legal-access confirmations, or promises that a route is rideable, lawful, open, quiet, low-traffic, suitable, or free from hazards.


10. Private Property, Access, Closures, and Traffic Laws

Untrack may display, recommend, or generate routes that appear to cross roads, paths, trails, private property, restricted areas, closed areas, construction zones, or areas requiring permission.

Untrack does not guarantee that any route is legally accessible, open, public, safe, permitted, or suitable. You are solely responsible for checking signs, local laws, closures, land-access rules, traffic rules, and obtaining any required permission before entering any area.

You must not use the Service to trespass, violate traffic laws, enter restricted areas, interfere with others, or endanger yourself or others.


11. Health, Fitness, and Training Disclaimer

Training suggestions, ride metrics, pace, speed, elevation, calories if offered, fitness summaries, activity summaries, auto-pause data, and route recommendations are for informational purposes only and are not medical, health, fitness, coaching, or professional advice.

Consult a qualified professional before starting or changing a training plan, and stop riding if conditions or your health make riding unsafe.


12. Your Content and Route Data

You may create, save, import, export, submit, or share content through the Service, including routes, rides, points, GPX files, profile information, preferences, feedback, and support messages (“User Content”).

You retain your rights in your User Content. You grant Untrack a limited, worldwide, non-exclusive, royalty-free license to host, store, process, display, reproduce, modify, transmit, and use your User Content only as needed to provide, operate, secure, troubleshoot, improve, and support the Service; comply with law; enforce these Terms; and provide features you request, such as route generation, ride recording, sharing, syncing, and GPX export.

You represent that you have the rights needed to submit or share User Content and that your User Content does not violate law, third-party rights, privacy rights, safety rules, or these Terms.


13. Public or Shared Content and Location Privacy

If you make a route, ride, profile, note, GPX file, feedback item, or share link public or share it with another person, it may reveal locations such as your home, workplace, routines, favorite roads, or real-time or near-real-time position.

Recipients may copy, save, screenshot, forward, export, or re-share it outside Untrack. Only share content and route data if you are comfortable with that visibility. Where privacy settings are available, you are responsible for choosing the settings appropriate for you.

You may not use the Service to:


15. Third-Party Services and Data Providers

Untrack relies on third-party services for functions such as authentication, App Store purchases, subscription entitlement management, hosting, databases, maps, routing, elevation, geospatial context, weather, notifications, analytics, diagnostics, logging, and support.

These services may include Apple, RevenueCat, Supabase, Mapbox, GraphHopper, OpenRouteService where enabled, OpenStreetMap/Overpass API, WeatherAPI.com, Expo Push Notifications, and other infrastructure or service providers used to operate the Service.

Third-party services and data may be unavailable, delayed, inaccurate, incomplete, outdated, or subject to their own terms and privacy policies. Untrack is not responsible for third-party data, outages, map errors, weather errors, routing errors, elevation errors, provider limitations, or provider changes outside our reasonable control.


16. Availability, Changes, and Beta Features

We may modify, suspend, discontinue, limit, or replace features at any time, including route generation, route providers, weather features, entitlement systems, Pro features, beta features, or experimental features.

Some features may be experimental, beta, incomplete, or limited. Beta and experimental features may be changed or removed without notice and may be less reliable than stable features.

We do not guarantee that the Service will be uninterrupted, error-free, secure, accurate, compatible with every device, or available in every location.


17. Intellectual Property

The Service, including software, design, interface, branding, logos, text, graphics, route-generation logic, and other materials, is owned by Untrack or its licensors and is protected by intellectual property laws.

These Terms do not transfer ownership of the Service to you. You receive only the limited right to use the Service according to these Terms and the Apple Standard EULA.

You may not copy, modify, distribute, sell, rent, sublicense, reverse engineer, or create derivative works from the Service except where permitted by law.


18. Termination

You may stop using the Service at any time. You may request account deletion in the app, currently available in **Settings → Profile → Delete Account**, or by contacting privacy@untrack.cc.

We may suspend or terminate your access if you violate these Terms, create legal or safety risk, misuse the Service, fail to pay where required, or if continued access would expose Untrack or others to risk.

Deleting your account may delete or de-identify account data and user-owned records unless retention is required or permitted for security, fraud prevention, legal compliance, dispute resolution, accounting, backups, or enforcement.

Deleting your Untrack account or uninstalling the app does not automatically cancel an Apple App Store subscription. You must cancel subscriptions in your Apple Account settings.


19. Disclaimers

To the maximum extent permitted by applicable law, the Service is provided “as is” and “as available,” without warranties of any kind, whether express, implied, statutory, or otherwise.

Untrack and the Protected Parties disclaim warranties of accuracy, completeness, availability, reliability, fitness for a particular purpose, merchantability, non-infringement, safety, legal access, route suitability, uninterrupted operation, and error-free performance.

No information provided through the Service, including maps, route generation, route recommendations, weather context, Route Confidence, road context, training route planning, ride metrics, activity summaries, GPX exports, support messages, or other app content, should be treated as a guarantee, professional advice, safety assurance, legal-access confirmation, medical advice, or emergency instruction.


20. Limitation of Liability

To the maximum extent permitted by applicable law, Untrack and the Protected Parties will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; loss of data; loss of profits; business interruption; personal injury; property damage; or damages arising from your route choices, outdoor activities, reliance on maps, routing, GPS, elevation, weather, Route Confidence, road-confidence indicators, third-party data, public or shared routes, device limitations, network limitations, or use of the Service contrary to these Terms.

The Service is developed and operated as a software product. Individual developers, owners, contributors, contractors, and technical providers involved in creating or maintaining the Service are not personally responsible for your route decisions, cycling activity, compliance with traffic laws, physical condition, equipment, road or trail conditions, weather, third-party data, GPS accuracy, or use of the Service, except where such exclusion is not permitted by applicable law.

Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for intentional misconduct, gross negligence, death or personal injury caused by negligence where such liability cannot be excluded, or non-waivable consumer rights.

Some jurisdictions do not allow certain exclusions or limitations, so some of the above may not apply to you.


21. Release and Indemnity

To the maximum extent permitted by applicable law, you release Untrack and the Protected Parties from claims, losses, damages, liabilities, costs, and expenses arising from or related to your cycling activities, route choices, reliance on maps, routing, GPS, elevation, weather, Route Confidence, road-confidence indicators, surface information, public or shared routes, or other informational content provided through the Service.

You agree to indemnify and hold harmless Untrack and the Protected Parties from and against claims, damages, losses, liabilities, costs, and expenses, including reasonable legal fees, arising from your misuse of the Service, violation of these Terms, violation of applicable law, infringement of third-party rights, unlawful entry onto private or restricted property, unsafe conduct, or content you create, upload, publish, export, or share through the Service.

This clause applies only to the extent permitted by applicable consumer law.

Your use of the Service is also governed by our Privacy Policy, available at:

23. Changes to These Terms

We may update these Terms from time to time. If changes are material, we will take reasonable steps to notify you, such as by updating the date above, posting notice in the app, or using another appropriate method.

Your continued use of the Service after updated Terms become effective means you accept the updated Terms. If you do not agree, you must stop using the Service.


24. Governing Law and Consumer Rights

These Terms are governed by the laws of Poland, without regard to conflict-of-law rules.

If you are a consumer, this choice of law does not deprive you of mandatory consumer protections of the country where you habitually reside. Courts in Poland will have jurisdiction unless mandatory consumer law gives you the right to bring or defend claims elsewhere.
